The office Attorney General of the US for the Northern District of New York stated that the CEO of Acme Powerwashing Inc. of Holley, New York, Mr. Nathaniel P. Lorenz, has been sent to prison eighteen months in federal jail for conning New York state DOT. Lorenz was found guilty of 8 counts of wire deceit and one count of mail deceit in November 2019. Acme had a contract with the state for bridge repairs and was required to clean and seal sections of concrete bridge decks using superior products that prolong the concrete’s useful life and avert the formation of holes. According to the prosecutor, Lorenz did not purchase the sealant but allocated the state DOT material besides using another firm that he possessed as the trader of record. However, that company did not sell anything (Slowey, 2019).

ACME Pwerwashing, Inc., Lorenz company contracted with the New York State Department of Transportation (NYSDOT) to procure cleaning and sealing services on several bridges in the buffalo and Binghamton areas.  ACME’s responsibilities were power washing bridges and smearing chemical sealers. The Federal Highway Administration, a section of the US Department of Transportation, funded the better part of these projects.

ACME was supposed to purchase a specific type of chemical sealer and then surrender documentary proof to the NYSDOT and the cash the ratified sealer used. Lorenz was convicted for buying less than the number of materials needed under ACME’s agreement with NYSDOT and providing fraudulent proof of purchase. Even though a firm known as Allied Building Products  Corp. was the only authorized dealer of the sealer, Lorenz, on several occasions, cheated NYSDOT that ACME had purchased the needed amount of the sealer from a firm known as S.E. Brett. Inc., where Lorenz was the sole owner (Department of Justice, 2019).

Eighteen months sentence, which was lesser than the 46 months wanted by the federal prosecuting attorney, was to be followed by two years managed to release and compensate $600,000, which is the total loss that the government suffered Lorenz deception. Lorenz fraud act reportedly saved ACME USD.500 000 in the cost of materials and approximately a cost of $ 1 million on work since 2012. The proof in court at trial showed that ACME, an NYSDOT service provider since the year 2010, was not purchasing the recommended amount of sealing chemicals hence saving more than $ 0.5 million in avoided material cost (Pollina, 2019).

Following Lorenz’s sentence, the US Legal representative for the northern district of New York noted that: “Lorenz stole from New York taxpayers by doing substandard maintenance work on bridges that most New York residents depend on. In collaboration with other state agencies, we will constantly watch over government-funded contractors to ensure that taxpayers get what they deserve.”

This case illustrates the grave risks attendant to misconduct in connection with federal contracts.  Had Lorenz’s counterparty been a reserved entity, he might never have been federally indicted, as the Department of Justice (DOJ) indicting policy on mail, as well as wire deception, states that “prosecution of fraud normally should not be assumed if the system employed has some secluded transaction among individuals with a trivial loss to the victims, in which case the parties need to be left to settle their differences using civil litigation in the government courts.”  This case was inspected by the United States Department of Transport, New York Office of Inspector General, in collaboration with the NYSDOT’s investigation Bureau and then prosecuted by the Assistant United States Attorney General Michael Barnett.
