Statutory Rape
Legally, statutory rape is sexual contact between an adult and an individual below the legal consent age. It is based on the premise that an individual is not in a position to consent to sexual intercourse until the person attains a particular age. Statutory rape law decree that even if the minor engaged in sexual intercourse willingly, the sex is not consensual.
A police record shows that a man was found having had intercourse with a minor. The man named Rico Watts, 19 years of Asheville, asked Jane Hallingse of Asheville of 13 years to sneak out of her home in order to drink alcohol and have sex. The victim and the perpetrator are close neighbors in their residence, and the girl’s family knows Watts, and he also knows that Jane is underage. On the evening of the 8th day of September 2020, the two were seen together, and CCTV footage shows the two going into Watts’ house.
The rule of law governing statutory rape is based on the premise that a minor is incapable of giving informed consent to sexual activities. In this case, for instance, the suspect is charged with felony statutory rape of a 13-year-old and is guilty of committing second-degree sexual exploitation of a minor. He is found guilty because Jane is below the consent age and therefore not legally considered mentally capable of consenting to sexual activity. Statutory rape is a serious crime, and the convict will either serve a jail term not exceeding fifteen years or a fine not exceeding $10,000. This is because of the relative age difference between the perpetrator and the victim.
