Gun Control
In the United States, America matters gun control is a controversial matter that has been in the limelight for a long time. Several federal bodies regulate the manufacture, trade, possession, transfer, recordkeeping, transport, and destruction of firearms, ammunition, and firearms accessories. On December 15, 1791, ratification was done that brought change alongside nine other articles in the Bill of Rights. For self-defense purposes, the Supreme Court of the United States of America affirmed the right to citizens owning firearms. This right was not unlimited and did not preclude the existence of long-standing prohibitions to felons and those with ill mental health. This auxiliary right had been a past influence of Sir Blackstone Williams under the Bill of Rights of 1689. Somewhat tags of rights as auxiliary were viewed in the milieu of the intrinsic purpose of a Bill of Rights, which is to strengthen a group with the capability to attain a jointly anticipated result, and not practically count or measure the significance of rights. Therefore, all the rights itemized in the Law of the land were auxiliary to Sir William Blackstone since all rights are only as good as the extent they are exercised in fact.
Different states also immensely put up laws guiding the rights involving the possession of the guns considering their current security states. As long as a state’s security level was above the bar set by the Federal government, there need not be an infringement of the rights to own a gun.1938 the then President Franklin d. Roosevelt signed the” Federal Firearms Act of 1938” to Law that required all firearms-related businesses to be licensed from Federal Firearms License. Later in 1939, the Supreme Court of the United States of America ruled that Congress court regulates the business around the gun-totting industries among the states through the National Firearms Act of 1934. Weapons were deemed as having no reasonable relationship with the effectiveness of regulated militia.
A spree of political assassinations that followed from 1968, including the assassination of Martin Luther King, John F. Kennedy, and Robert F. Kennedy, pushed the Congress for the Gun Control Act of 1968—thoroughly repelling the Federal Firearms Act, that regulated “dangerous devices” which included the bombs, mines and other explosives. Further, there was a restriction on machine guns and military-style weapons. There required a serial number for every manufactured arm or imported arm. There was also no guarantee of importing stylish military arms. A minimum age requirement of 21 years was imposed on the purchasing and owning of the gun. The Gun Control Act also barred the selling of firearms to felons and ill-mentally. When Ronald Reagan’s administration implemented the “Firearm Owners Protection Act,” this prohibited the national registry of recording gun dealers, limited ATF inspections to conduct only yearly inspection unless multiple infractions had been observed. This policy also allowed the gun dealers to sell guns in their store shows in their respective states and loosened the regulations around the sale and transfer of the firearms. However, the FOPA also prohibited citizens from owning machine guns and transferring the same. This policy also defined “silencer” to include those parts that made the firearms silent.
Another policy,” Brady Handgun Violence Protection Act” which was named after a secretary to the press of the White House who was disabled as a victim during the attempted assassination of Ronald Reagan, was into Law by President Bill Clinton this included the Federal Assault Weapons Ban which effectively banned the manufacturing trading and ownership of specific military weapons. This particular Act required that a background check was to be done and system information maintained by the Federal Bureau of Investigations. This was in 1993, and later in 1994, the Violent Crime Control and Law Enforcement Act signed to Law with President Bill Clinton which included the Federal Assault Weapons Ban, which effectively barred the manufacturing, trading, and ownership of AR-15 style rifles and barred high-capacity ammunition magazines that had a capacity of 10 rounds. Some of the arms that were now illegally possessed were grandfathered; this particular ban came to a halt in 2004.
In 2003 Todd Tiahrt proposed Tiahrt Amendment that limited ATF only to give information the arms databases when it was to be used by Law enforcement agencies or prosecution to connect to a scene under investigations. In 2005 the administration of George W. Bush brought about The Protection of Lawful Commerce in Arms Act, which protected the gun manufacturer from being named civil state suits by those who used their weapons to commit crimes. Later come 2008, the Supreme Court ruled in the mandate of Columbia v. Heller, where the Court stated, “the right to bear arms is not unlimited and that guns and their ownership would continue to be regulated.” In 2010 the Court further passed a ruling in McDonald v. Chicago that the Second Amendment is considered against the states, later in 2016 in the case Caetano V. Massachusetts that “The Second Amendment extends, Prima Facie, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding.”
